Prestige Laser Cleaning
These Terms & Conditions apply to services provided by Prestige Laser Cleaning ("Prestige Laser Cleaning", "we", "us" or "our") to customers ("you" or "your").
By accepting a quote, booking our services or otherwise engaging Prestige Laser Cleaning to perform work, you agree to these Terms & Conditions.
1. Our Services
Prestige Laser Cleaning provides professional laser cleaning and surface preparation services for a range of materials, equipment, structures and surfaces.
Our services may include the removal or treatment of suitable:

Rust and corrosion
-
Paint and coatings
-
Oxidation
-
Carbon and soot
-
Grease and oil residue
-
Surface contamination
-
Scale and other suitable deposits
-
Other surface materials suitable for laser cleaning
The suitability of laser cleaning depends on the material, surface condition, coating, contamination and other characteristics of the item being treated.
Prestige Laser Cleaning reserves the right to decline or stop work where we reasonably determine that the proposed cleaning process is unsuitable or presents an unacceptable risk to the item, surrounding property, people or environment.
2. Quotes & Estimates
Quotes are provided based on the information available to Prestige Laser Cleaning at the time of quoting.
Where possible, customers should provide accurate descriptions, measurements and photographs of the items or surfaces requiring cleaning.
A quote may change if the actual condition, size, material, coating or level of contamination differs substantially from the information provided.
If additional work is required that was not included in the original quote, we will discuss the additional work and associated costs with you before proceeding where reasonably practicable.
Unless otherwise stated, quotes are valid for 30 days from the date issued.
A quote does not constitute acceptance of a booking until the quote has been accepted and the job has been confirmed by Prestige Laser Cleaning.
3. Testing & Suitability
Laser cleaning is a controlled process, however different materials, coatings and surface conditions can respond differently to laser treatment.
Where appropriate, Prestige Laser Cleaning may conduct a test area before commencing the main work.
The purpose of testing is to determine suitable laser settings and assess the expected cleaning result.
Customers acknowledge that some surfaces may have pre-existing damage, corrosion, deterioration, previous repairs, coatings or other conditions that may become visible once contamination or coatings are removed.
Where a particular finish or result is important, customers should communicate their requirements before work begins.
4. Customer Responsibilities
Customers are responsible for providing accurate information about the item or surface to be cleaned, including any known:

Material or substrate

Coatings or previous treatments
-
Structural damage
-
Repairs or modifications
-
Sensitive components
-
Electrical components
-
Fuel, chemical or hazardous-material exposure
-
Other conditions that may affect the cleaning process
Customers must inform Prestige Laser Cleaning of any known hazards associated with the item or work area.
Customers must also provide reasonable access to the work area and ensure that the area is reasonably suitable for the agreed work to be carried out.
Where an item contains fuel, chemicals, hazardous substances, pressurised systems, batteries or other potentially dangerous materials, Prestige Laser Cleaning may require the item to be appropriately prepared, isolated, emptied, cleaned or made safe before work can commence.
5. Hazardous Materials & Coatings
Prestige Laser Cleaning may encounter old paints, coatings, residues or other materials that could present a health, environmental or safety risk when disturbed.
If we reasonably believe that an item or coating may contain hazardous materials, we may stop work and require further information, testing, removal or specialist handling before proceeding.
Prestige Laser Cleaning is not responsible for identifying every hazardous substance that may be present in an item where the customer has not disclosed it or where it cannot reasonably be identified before work begins.
Additional costs associated with specialist handling, testing, disposal or preparation may apply where agreed with the customer.
6. Pre-Existing Damage & Condition
Prestige Laser Cleaning is not responsible for damage or deterioration that existed before work commenced.
This may include, but is not limited to:

Existing corrosion or metal loss
-
Cracks
-
Fractures
-
Previous repairs
-
Weak or deteriorated materials
-
Flaking or failing coatings
-
Hidden damage
-
Structural deterioration
-
Damaged threads or fasteners
-
Brittle, degraded or weakened components
Removing rust, paint, coatings or other material may reveal previously hidden damage or defects.
Where we identify a condition that may make continued cleaning unsuitable, we may pause or stop the work and discuss the situation with you.
7. Cleaning Results & Surface Finish
Prestige Laser Cleaning will perform services with reasonable care and skill and in accordance with the agreed scope of work.
The final appearance of a cleaned surface can vary depending on the material, condition, contamination, previous treatments and other factors.
Laser cleaning does not necessarily restore an item to a new or original condition.
Where required, additional processes such as polishing, grinding, machining, coating, painting, passivation, sealing or other finishing treatments may be required after laser cleaning.
Prestige Laser Cleaning can discuss suitable post-cleaning options where requested.
8. Coatings & Surface Preparation
Where laser cleaning is used to prepare a surface for painting, powder coating, welding, inspection or another process, Prestige Laser Cleaning does not guarantee the performance of a subsequent coating, treatment or process performed by another party.
The customer or subsequent contractor is responsible for ensuring that the cleaned surface is suitable for the intended application and that any required preparation or treatment is completed.
9. Care of Customer Property
Prestige Laser Cleaning will take reasonable care when handling customer property.
Customers are responsible for informing us of any fragile, valuable, historic, modified or otherwise sensitive items or components before work begins.
For delicate, antique, historic or unusual items, we may recommend a test area or additional assessment before proceeding.
Where appropriate, customers may be asked to approve a test area before the main cleaning work commences.
10. Access & Site Conditions
Where work is performed at the customer's premises or another nominated location, the customer is responsible for providing reasonable access and a suitable work area.
The customer must inform Prestige Laser Cleaning of relevant site hazards or restrictions.
Work may be delayed, rescheduled or stopped where conditions are unsafe or unsuitable, including circumstances involving:

Severe weather
-
Unsafe access
-
Inadequate lighting
-
Restricted working space
-
Electrical or other site hazards
-
Hazardous materials
-
Other conditions that prevent the work from being safely performed
Where possible, we will discuss any delay or rescheduling with the customer.
11. Mobile & On-Site Services
For mobile or on-site services, additional travel, access or site-related charges may apply where specified in the quote.
Customers are responsible for ensuring that any required permissions to access private, commercial or restricted premises have been obtained.
Prestige Laser Cleaning is not responsible for delays caused by the customer, site access restrictions or conditions outside our reasonable control.
12. Pricing & Payment
The total price and payment terms will be stated on the relevant quote or invoice.
Unless otherwise agreed in writing:

Payment is due by the date specified on the invoice.

Additional work must be agreed before it is undertaken where reasonably practicable.

Additional charges may apply for work outside the original scope.

Any applicable travel or other agreed charges will be included in the quote or communicated before they are incurred.
Prestige Laser Cleaning may require a deposit or progress payment for larger or specialised jobs where specified in the quote.
13. Cancellations & Rescheduling
If you need to cancel or reschedule a booking, please provide as much notice as reasonably possible.
Where a booking is cancelled or rescheduled at short notice, Prestige Laser Cleaning may charge reasonable costs that have already been incurred or that cannot reasonably be recovered, where permitted by law and where those costs have been disclosed or agreed.
For larger or specialised jobs, separate cancellation terms may be included in the quote.
Any cancellation or rescheduling fee will be reasonable and will not limit any rights you have under the Australian Consumer Law.
14. Payment Disputes
If you believe there is an issue with an invoice or completed service, please contact Prestige Laser Cleaning as soon as reasonably possible so that we can discuss and attempt to resolve the issue.
Customers should provide details of the issue and any relevant photographs or information where appropriate.
Nothing in these Terms & Conditions limits a customer's rights under the Australian Consumer Law.
15. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law provides a consumer guarantee or other mandatory right, those rights continue to apply.
Our services will be provided with due care and skill and in accordance with applicable consumer guarantees.
16. Liability
To the extent permitted by law, Prestige Laser Cleaning's liability is limited to the extent permitted by applicable legislation.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded, including rights and remedies available under the Australian Consumer Law.
Where a customer provides incorrect or incomplete information about an item, material, coating, condition or hazard, Prestige Laser Cleaning will not be responsible for consequences arising directly from that information to the extent permitted by law.
17. Unforeseen Conditions
During cleaning, previously hidden conditions may become visible or may affect the work.
These may include hidden corrosion, repairs, cracks, material deterioration, multiple coating layers, incompatible materials or other conditions that could not reasonably be identified before work commenced.
Where such conditions materially affect the work, Prestige Laser Cleaning may pause the job and discuss available options with the customer.
Additional work or costs will be discussed and agreed before proceeding where reasonably practicable.
18. Photographs & Job Documentation
Prestige Laser Cleaning may take photographs of completed work for internal records, quoting, quality control and documentation purposes.
We will not publish identifiable customer information or photographs of private property for marketing purposes without appropriate permission.
Where customers provide photographs to Prestige Laser Cleaning for quoting or assessment, those photographs may be retained and used for the purpose of assessing and providing the requested services in accordance with our Privacy Policy.
19. Intellectual Property
Unless otherwise stated, the Prestige Laser Cleaning name, logo, website content, original photographs, graphics, written material and other original business content remain the property of Prestige Laser Cleaning or the relevant rights holder.
You must not reproduce, copy, modify or use our original business content for commercial purposes without permission.
This does not affect any rights you may have in materials or photographs that you provide to us.
20. Privacy
Personal information provided to Prestige Laser Cleaning will be handled in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, how we use it, how it may be stored and how you can contact us about your personal information.
21. Dispute Resolution
If a dispute arises regarding our services, both parties should first attempt to resolve the matter directly and in good faith.
If the matter cannot be resolved directly, either party may seek assistance from an appropriate dispute resolution service, consumer protection agency or other relevant authority.
Nothing in this section prevents a customer from exercising rights available under the Australian Consumer Law.
22. Changes to These Terms & Conditions
Prestige Laser Cleaning may update these Terms & Conditions from time to time.
The version applicable to a particular job will generally be the version provided or made available when the quote or booking is accepted, unless otherwise agreed.
The latest version will be published on our website.
23. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
Any legal proceedings relating to these Terms & Conditions will be subject to the applicable courts and laws of Victoria, subject to any mandatory rights or jurisdiction provided by Australian law.
